Erik and Lyle Menendez's bid for freedom was on indefinite hold Friday, following an emotional day in court that ended when a judge scheduled a May 9 motions hearing to discuss the admissibility of a state parole board risk-assessment report and an anticipated defense motion seeking to recuse the District Attorney's Office from the case.

A long-awaited resentencing hearing for Lyle and Erik Menendez ground to a halt Thursday just hours after attorneys arrived at the courthouse in Van Nuys, partly over a risk assessment report on the brothers that was was not intended for this week's court proceeding.

The Menendez hearing is now under way. It started about 15 minutes late, possibly because the LA District Attorney was giving a press conference outside the court. The brothers have joined via a video link from prison. They are incarcerated near San Diego at a prison just north of the border with Tijuana, Mexico.
